지금 도와 주고 있는데 작년 봄부터 준비해서 서류를 마쳤는데 지난 12월에도 I 360을 신청하지 않아서 왜 하지 않느냐고 제가 재촉하며 메일을 보냈더니 이런 답이 왔습니다.
The project was initiated last year and put on hold until Daniel extended his status. I do understand the process has been ongoing for quite some time. We are working on the immigrant petition and will send it for signature when the forms and supporting documentation have been finalized.
Regarding Daniel’s concern about his status and the timing of the filings: Daniel’s R-1 status (and his work/travel authorization) expires November 2013, and USCIS is processing I-360s within 5 months. The AOS will be filed upon approval of the I-360, and once the AOS is filed, Daniel will be authorized to remain in the U.S. as an AOS applicant.
The applications for employment authorization (EAD) and travel authorization (AP) are filed with the AOS and take 3-4 months to process. Based on these processing times, Daniel would have uninterrupted work and travel authorization even if his I-360 were filed a year from now. Despite this wide timeframe, we are, as I mentioned, proceeding with the I-360 at this time and will send the forms to John once they have been finalized.
